Benjamin Gerber is an experienced trial lawyer focusing his practice on helping those who have been injured on the job. He is also a founding partner of Gerber & Elkins.

Ben Gerber is a Georgia workers’ compensation attorney with more than two decades of experience representing injured workers.

His career started on the defense side. After returning to Georgia in 2001, he spent three years working for insurance defense firms, learning how carriers evaluate claims, build strategies, and decide when to fight. That experience shaped how he approaches every case today. In 2004, he moved to a plaintiffs’ firm handling personal injury and workers’ compensation matters and has represented claimants ever since.

In 2010, Ben founded his own Atlanta-based firm focused exclusively on Georgia workers’ compensation law. In 2012, he opened a second office in Athens and a third in Columbus in 2022. In 2026, he and partner Natalie Elkins established Gerber & Elkins, bringing together a team of six attorneys representing injured workers across Georgia.

Ben holds a 10.0/10.0 Superb rating from Avvo, the platform’s highest designation. Georgia Super Lawyers has recognized him for 15 consecutive years, a distinction that goes to the top five percent of attorneys in the state.

Professional involvement

Ben serves on the Executive Board of the Workers’ Injury Law & Advocacy Group (WILG), the leading national nonprofit membership organization dedicated to the interests of workers and families affected by workplace injuries and occupational illness. WILG advances the quality of legal representation for injured workers through education, legislative advocacy, and engagement with judicial and legislative developments across the country. Ben chairs the WILG Scholarship Committee, has helped plan both regional and national WILG conferences, and received the organization’s Rising Star Award in 2018.

In Georgia, he has served on the Board of Directors of the Workers’ Compensation Claimant’s Lawyers (WCCL) and the board of the Georgia Insurance Workers’ Advocates (GIWA). He is a member of the Georgia Trial Lawyers Association (GTLA) and serves on the Workers’ Compensation Section Board of the Atlanta Bar Association.

Beyond the law, Ben serves on the board of Cliff Valley School and has served as a Junior Board Member of the Atlanta Volunteer Lawyers Foundation, which provides civil legal services to low-income residents of the Atlanta area.

He speaks regularly at bar association events and continuing legal education programs on Georgia workers’ compensation law.

Education

Ben graduated cum laude from the University of Georgia, where he received a bachelor’s degree in political science. He earned his Juris Doctor degree from George Washington University Law School. While in law school, it was at the Consumer Affairs Clinic where he first began helping individuals stand up to big corporations. He also had legal internships at the Department of Justice and the United States District Court for the District of Columbia.

Personal

Ben is a husband and the father of three. His two eldest are enrolled at the University of Georgia; his youngest is in high school. Outside the office, he competes in triathlons and ultra-endurance events.
