What is the hardest injury to prove for workers’ comp?

In general, the hardest workers’ compensation injuries to prove are the ones that do not stem from a single, obvious accident. If there is no clear event and no witnesses, insurance companies are more likely to question whether the injury is truly work-related.

For example, work-related hearing loss often develops gradually over years. An insurance company may argue it’s due to aging instead of job-related exposure to loud noise or ototoxic chemicals. Without strong medical testing and proof of workplace noise levels, these cases can be tough.

  • Preexisting conditions that are made worse by work. If your job aggravates an old injury or medical issue, you may be entitled to benefits.

How to file a workers’ compensation claim in Georgia

If you are hurt on the job in Georgia, workers’ compensation can provide medical benefits for all necessary care, indemnity benefits that cover two-thirds of your lost wages while you recover, and even permanent disability benefits if you’re unable to ever return to work.

However, to receive these benefits, you must follow these steps:

  1. Report the injury immediately. You must notify your employer within 30 days of the accident or the discovery of an occupational disease. The sooner you report it, the better. Waiting can raise red flags and put your claim at risk.
  2. Seek medical treatment. Your employer should provide a list of approved doctors. In most cases, you must choose from that list for your treatment to be covered.
  3. File a claim with the State Board. Next, you need to file a workers’ comp claim by submitting Form WC-14 to the Georgia State Board of Workers’ Compensation.
  4. Follow your doctor’s restrictions. Returning to work too soon or ignoring medical advice while on light-duty restrictions can affect your benefits.

Please note that while most Georgia employers with 3 or more employees are required to carry workers’ compensation insurance, independent contractors are generally not covered. The problem is that many workers are misclassified as independent contractors when they should legally be treated as employees. If that happens, you could still have a valid claim.
