Local workers’ comp law firm in Americus fighting for the rights of workers with serious on-the-job injuries and diseases

When you’re dealing with a serious work injury or occupational illness, the last thing you should have to do is fight the insurance company to get your basic needs met.

Yet many workers in Americus face exactly that—delayed workers’ comp checks, lowball settlement offers that don’t come close to covering their past and future medical expenses, and even the outright denial of benefits for legitimate work injuries.

At Gerber & Elkins, we’re proud to have built our practice by standing up for Georgia workers just like you. With more than 100 years of combined experience in workers’ comp law, our team understands how insurers operate and how to push back when they treat you unfairly.

And because we’re local, we know the challenges workers in Sumter County face when filing a claim and how to step in early and hold insurers accountable so you can get the full benefits you’re owed under Georgia law.

Workers’ comp was designed to protect you.

When the system fails, we step in.

Highly recommend
“I had the pleasure of having Gerber & Elkins represent me during a difficult time of recovering my knee. They made sure all my questions were answered and that all my needs were done. I highly recommend this law firm!”

Great to work with
“I would like to say the law firm of Gerber & Elkins was great, and I’d recommend them to anyone who’s seeking any legal help. It was my first time working with them and I was recommended by my uncle who also said they were great to work with. My attorney Karen G. Lowell was very professional and consistent with my case and not one time did I have to contact their firm to find out anything. They contacted me and I allowed them to do their job, which they did very well. If anything else comes up to where I need an attorney I will be contacting them again and also recommending them to others.”

Answers to top questions about workers’ comp claims in Americus

Does workers’ comp cover minor injuries in Georgia?

Yes. Georgia’s workers’ compensation system is designed to cover everything from minor injuries to catastrophic injuries and illnesses, as well as work-related deaths, as long as they’re directly related to your job.

That means even if your injury doesn’t keep you out of work for long, you may still be entitled to medical treatment and other benefits.

Workers’ comp typically covers the following types of work-related conditions:

  • One-time injuries such as concussions, brain bleeds, crush injuries, and spinal cord damage from accidents at work
  • Aggravation of pre-existing conditions if your work duties make an old injury or health problem worse (e.g., heavy lifting at work worsening a back issue or repetitive motions aggravating arthritis)
  • Repetitive stress injuries like carpal tunnel syndrome or tendonitis that build up over time.
  • Occupational diseases such as lung disease, hearing loss, vision loss, lead poisoning, and cancer linked to toxic chemicals or other dangers at work

The key to getting workers’ comp for any of these conditions is proving that they were directly caused by your job.

While this is fairly easy to do with an injury like a broken bone from a work-related car accident, it can be more difficult with an occupational disease like lead poisoning because workers can also be exposed to lead outside of work.

Fortunately, if your workers’ comp claim is denied on the grounds that your condition isn’t work-related, you do have the option to file a workers’ comp appeal.

At that point, it’s smart to discuss your case with a local Georgia work injury lawyer who can connect you with medical experts and help you gather the evidence you need to secure your benefits.

Do all workers qualify for workers’ comp in Americus?

No, but many do. In Georgia, most employees are covered by workers’ compensation as long as they work for an employer with at least 3 employees. That includes seasonal and part-time workers, not just people on a full-time schedule.

However, there are some exceptions. Independent contractors, like Uber and Lyft drivers, generally aren’t covered, although some employers purposely misclassify workers to avoid paying benefits.

Certain types of jobs, like farm labor, railroad work, or domestic help in private homes, may also fall outside the system. Business owners and the self-employed are typically excluded too, unless they choose to opt in.

If you’re unsure whether you’re covered, the Georgia State Board of Workers’ Compensation has a free online tool where you can look up your employer’s coverage.

And if you’ve been told you don’t qualify, it’s always worth getting a second opinion—many denials are based on classification errors or other mistakes that an experienced Americus work injury compensation lawyer can help you sort out.

How much does workers’ comp pay after an injury in Americus?

If you’re hurt on the job in Americus, the amount you can receive through workers’ compensation depends on how your injury affects your health and your ability to earn a living. Georgia’s system provides several different types of benefits to cover both medical care and lost wages.

Medical benefits

All approved medical treatment related to your injury should be covered. Medical benefits cover ER visits, surgeries, follow-up care, prescriptions, physical therapy, and even mileage to and from appointments.

You don’t have to pay deductibles or copays for this care—it’s handled by workers’ comp as long as you see an authorized provider.

Indemnity benefits

When it comes to replacing your paycheck, indemnity benefits (also called wage loss benefits) vary depending on your work status:

  • If you can’t work at all, you may qualify for temporary total disability (TTD) benefits, which pay two-thirds of your average weekly wage, capped at $800 per week (for injuries after July 1, 2023).
  • If you return to work but earn less because of your injury, temporary partial disability (TPD) benefits cover part of that gap.
  • If your injury leaves you with permanent limitations, you may be eligible for permanent partial disability (PPD) benefits, based on a disability rating from your doctor.
  • In the most serious cases where you can never return to work, lifetime wage replacement benefits may be available, sometimes referred to as permanent total disability (PTD) benefits.
Death benefits

Workers’ comp can also provide death benefits if a job-related injury or illness proves fatal. In those cases, certain dependents may receive weekly income benefits plus up to $7,500 in funeral expenses.

It’s important to understand that workers’ comp benefits aren’t automatic, so you’ll need to take steps to file a claim, and your time is limited.

To protect your right to compensation, you must report your injury within 30 days, see a doctor approved by your employer, and file a claim with the State Board of Workers’ Compensation within 1 year.

Missing either of these deadlines could put your benefits at risk.
