Made me feel at ease
“Natalie Elkins is someone I highly recommend. She kept me informed at all times and provided me with excellent care. I suffer from anxiety and she made me feel at ease. When I say her work is impeccable, I mean just that. Suffered a neck and shoulder injury from working in a warehouse. This was the first attorney I called to get the help I need and I am so glad I came across this place. Thank you, Natalie. I hope you see this review. The outcome of this whole ordeal changed my life. My life is much better thanks to this attorney. God Bless.”

Kept my best interest at heart
“Ben was straight up and down. Never talked in circles. He kept my best interest at heart even when I got impatient. His staff was helpful and friendly. Though the process was not easy, Ben Gerber and associates made it as easy as they could. Ben got me the medical treatment I needed when the insurance company didn’t want to let me see a doctor, even though I needed knee surgery. He got it done. I recommend Ben Gerber to anyone with a workman’s comp issue. Thanks again, Ben!”

Delivered results
“I would definitely recommend Natalie Elkins for your worker’s compensation case. She was able to provide information and deliver results. The prior lawyer couldn’t deliver on his promise to get a settlement. Natalie not only kept in contact with me; she was able to provide any updates on my case. I was never left wondering. If you’re looking for a professional, knowledgeable and caring attorney don’t hesitate to call Gerber & Elkins Attorney’s to settle your case. You will not regret it.”

FAQs about LaGrange workers’ comp claims

Which injuries are covered by workers’ comp in LaGrange, Georgia?

In Georgia, workers’ compensation doesn’t just apply to sudden accidents and injuries—it also covers a wide range of injuries and health issues that develop gradually because of your job.

If you’re an employee (not an independent contractor) and your condition is tied to the work you do, there’s a good chance you’re eligible for benefits, even if no one was at fault or you caused the accident yourself.

Here are the most common types of injuries and illnesses covered under Georgia workers’ comp:

  • Injuries from a single accident. If you’re injured at work from a fall, electrical accident, vehicle crash, or any other accident and you suffer an injury like a crush injury, scald burn, spinal cord injury, or concussion, it should be covered by workers’ comp.
  • Repetitive motion injuries. Jobs that require the same movements over and over, like typing, stocking shelves, or assembly work, can lead to conditions like tendonitis or arthritis. These repetitive stress injuries are often covered, though proving they’re work-related can sometimes be difficult without legal help.
  • Diseases and illnesses from long-term exposure. If your job exposed you to chemicals, loud noise, dust, or other harmful conditions that caused an occupational disease like cancer, silicosis, asthma, hearing loss, vision loss, or chronic pain, you may be covered.
  • Aggravated pre-existing conditions. If a prior injury or pre-existing health problem becomes worse because of your job duties (e.g., an old shoulder injury flares up due to repetitive overhead lifting), you may qualify for benefits.

If you’ve been injured or developed a serious medical issue because of your job and your claim is being scrutinized, talk to a local LaGrange workers’ compensation attorney about your situation and possible next steps.

What does workers’ comp pay for after a work injury or illness in LaGrange?

In LaGrange, Georgia, workers’ compensation benefits can help cover some of your most urgent needs—especially when you’re unable to work. Here’s what workers’ comp typically pays for:

  • Medical care. All authorized medical treatment related to your injury or illness is covered. This includes doctor visits, hospital stays, physical therapy, prescription medications, surgeries, and any necessary medical equipment—without any out-of-pocket cost to you.
  • Vocational rehabilitation. If you can’t return to your old job, you may be eligible for job training or career counseling to help you find a new line of work.
  • Wage replacement. If your injury prevents you from working, you can receive wage loss benefits. Georgia typically pays about two-thirds of your average weekly wage, up to a maximum set by the state ($800 per week as of July 2023). These benefits are not taxed.
  • Death benefits. If a loved one passes away due to a work-related injury or illness, their dependents may receive compensation to help cover funeral expenses and lost income.

If you’re unsure whether you’re getting the full benefits you deserve or your claim has been denied or delayed, reach out to the LaGrange work injury compensation lawyers at Gerber & Elkins. We can calculate how much your injury is worth and negotiate with the insurers to maximize your benefits.

How do I file a workman’s comp claim in LaGrange, Georgia?

You don’t automatically get benefits after an injury at work in Georgia. There’s a process you’ll need to follow, and even small delays or mistakes can compromise your claim. Here are the basic steps to file a work injury claim in Georgia:

  1. Tell your employer ASAP. Let your boss or supervisor know about your injury as soon as you can. You’ve got up to 30 days after an injury or occupational disease diagnosis to report it, but the sooner, the better. If you can, put it in writing and keep a copy just in case anything gets questioned later.
  2. Go to the right doctor. Your employer should give you a list of approved doctors, called a “panel of physicians.” To have your medical bills covered, you’ll need to pick someone from that list. In an emergency, go wherever is closest—but be sure to follow up with an approved doctor afterward.
  3. File a claim. Filing Form WC-14 officially starts your claim with the Georgia State Board of Workers’ Compensation. Once you fill it out, send copies to the Board, your employer, and their insurance company.

Once your claim is filed, the insurance company has 21 days to respond. If they approve it, you should start getting benefits.

If they deny it, you can request a hearing to appeal the decision, but it’s highly recommended that you seek legal help with the process, as you’re likely facing an uphill battle for benefits at that point.
